Class 4 felonies carry penalties of one to three years in prison, but judges also can give a sentence of probation or conditional discharge, which is similar to probation but with less strict conditions. Linn also could impose a fine as well as order restitution.

The Emmett Till Anti-Lynching Act, named for the Chicago teen and authored by Rush, states a crime can be prosecuted as a lynching when a conspiracy to commit a hate crime results in death or serious bodily injury. Emmett Till, the 14-year-old son of Mamie Till-Mobley, was murdered in Mississippi in 1955. The act first passed the House of Representatives in February 2020, but was blocked when Sen. Cortez-Milan had come to the party to confront Melendez, who had exchanged words with the younger sister of Cortez-Milan at a party weeks before.
Still, because both defendants have shown remorse and lived otherwise “exemplary lives,” Jackson rejected a request by prosecutors for a sentence of home confinement. Instead, she sentenced each to 18 months of probation and ordered each to perform 100 hours of community service. They must also pay a total of $4,500 in fines and restitution.
