Lake County prosecutors have filed reckless homicide charges against a man they say was drag racing just before he crashed his car into another driven by an elderly man in Beach Park in October, killing him.

Tabios J. Day, 32, of Waukegan, is also facing felony counts of aggravated reckless driving and aggravated street racing stemming from the collision in which Peter Kliora, 78, was killed.

On Tuesday, authorities said Day, of the 700 block of West Glen Flora Avenue, was not yet in custody, but a warrant had been issued for his arrest.

Day ran into Kliora’s Toyota Prius at the intersection of Howard Street and Sheridan Road in Beach Park at around 1:15 p.m. on Oct. 10. Kliora was turning left from Howard onto northbound Sheridan Road when Day, who was southbound on Sheridan, ran into his vehicle.

Authorities allege that Day’s Infiniti M35 had been going as fast as 100 mph just before the crash as he was drag racing another motorist.

Kliora, a U.S. Army veteran and Beach Park resident, had to be extricated from his car and was later pronounced dead at a hospital. Day suffered non-life-threatening injuries.

Following the investigation by the Lake County sheriff’s office, a grand jury handed down the indictments against Day last week.
